This Indenture, made this 16th day February in the year of our Lord one thousand eight hundred and forty-eight between Charles Harris of the one part Joseph P. Gaunt of the second part and John C. Harris, all of the county of Botetourt, of the third part.  Whereas, the said Charles Harris is justly indebted to John C. Harris in the sum of sixty-four dollars and 50 cents due by note due on the 15th day of February 1848.  Now this indenture witnessed, that for and in consideration of the premises, and for the further consideration of the sum of one dollar, lawful money of Virginia, to the said Charles Harris in hand paid by the said Joseph P. Gaunt, the receipt whereof is hereby acknowledged, he the said Charles Harris has granted bargained and sold, and by these presents does grant bargain and sell unto the said Joseph P. Gaunt two bay mares, one sucking calf, five head of hogs, his crop of wheat, 10 bushels sawed, 1 Bed & bedding, 1 trap? clock, belonging to the said Charles Harris together with all and singular the appurtenances thereto belonging or in any wise appertaining, to have and to hold the said personal property unto the said Joseph his heirs and assigns forever to the only proper use and be hoof of the said Joseph P. Gaunt his heirs and assigns forever, and the said Charles Harris for himself, his heirs, executors and administrators doth covenant with the said Joseph P. Gaunt heirs assigns, to warrant and forever defend the said personal property against the claim or claims of him the said Charles Harris and all other persons. 

     Upon Trust, nevertheless, that the said Joseph P. Gaunt shall permit the said Charles Harris to remain in quiet and peaceable possession of the said personal property until default be made in the payment of the said sum of money or any part thereof, and then upon this further trust, that so soon after the happening of such default as the said Jno. C Harris or his legal representatives shall  order, or the said Charles Harris or his legal representatives shall request, the said Joseph P. Gaunt shall proceed  to sell the said personal property hereby conveyed, or so much thereof as he may think sufficient for the purpose, and shall think proper to sell, to the highest bidder, for ready money, at public auction, after having given at least ten days notice of the time and place of sale advertisement at his discretion and out of the moneys arising from such sale, shall after satisfaction the changes thereof and all other expenses attending the premises, pay to the said John C. Harris the said sum of Sixty Four dollars and 50 cents with interest and costs, and the balance, if any, shall pay to the said Charles Harris his heirs, executors, administrators or assigns.  But, if no default be made in the payment of the said sum of money, on the 1st day of January 1850, then this indenture to be void, otherwise to remain in full force & virtue.  In witness whereof, the said parties to these presents have hereunto set their hands and affixed their seals the day and year first above written.

John Harris to Green James

This Indenture made this 16th day of January in the year of our Lord one thousand eight hundred and fifty, between John Harris of the first part, and Green James of the second part, and James Luster of the third part.  Whereas the said John Harris is justly indebted to the said James Luster, in the sum of four hundred and sixty five dollars by bond bearing date the 16th day of January 1850, and due one day after the date thereof.  Now this indenture witnessed that for and inconsideration of the premises, and for further consideration of the sum of one dollar, lawful money of Virginia to the said John Harris in hand paid by the said Green James, the receipt whereof is hereby acknowledged and sold and by these presents doth grant bargained and sell unto the said Green James his heirs and assigns, the following personal property to wit: four head of horses, viz; one large sorrel horse, one sorrel stallion, and two bay mares. One large wagon and wagon body, four sets of wagon gear, one pair of hay lathers, one clock, one rifle gun, 1 dinning table, 1 breakfast ditto, 1 cupboard, 1 Bearner?, 2 feather beds, and bedding, 2 bedsteads, half dozen chairs, Cupboard ware of all kinds. cooking utensils, rocking cradle, 500 lbs port, and some beef say 100 lbs, together with all and singular the appurtenances thereto belonging, or in anywise appertaining, to have and to hold the said personal property unto the said Green James his heirs and assigns forever, to the only proper use and behoof of the said Green James his heirs and assigns forever. And the said John Harris, for himself, his heirs, executors and administrators, doth covenant with the said Green James his heirs and assigns to warrant and forever defend the said property against the claim or claims of him the said John Harris.

Upon Trust,  nevertheless, that the said Green James shall permit the said John Harris to remain in quiet and peaceable possession of the said property until the default be make in the payment of the said sum of money, or any part thereof, and there upon this further trust, that so soon after the happening of such default as the said James Luster, of his legal representatives shall order, or the said John Harris or his legal representatives shall request the said Green James shall procure to sell the said property or so much thereof as he may think sufficient for the purpose, and shall think proper to sell, to the highest bidder, for ready money, at public auction, after having given at least twenty days notice of the time and place of sale, by advertisement at the front door of the Court house of Botetourt County, and out of the monies arising from such sale, shall, after satisfying the charges thereof, and all other expenses attending the premises, pay to the said James Luster, the said sum of $465 - with the legal interest which may have accrued, and the balance, if any, shall pay to the said John Harris his heirs, executors, administrators or assigns. But, if no default be made in the payment of the said sum of money, on the first day of January, 1851, then this indenture to be void, otherwise to remain in full force and virtue. In witness, the said parties to these presents have hereunto set their hands and affixed their seals, the day and year first above written.

This Deed made this 10th day of February in the year of our Lord one thousand and fifty three between Jacob Haymaker and Christina his wife of the one part and Charles Thos Harris of the other part, Witnessed that in consideration of the sum of Sixteen Dollars and fifty cents, to them in hand paid by the said Thomas Harris by the said Thomas Harris at or before the sealing and delivery of these presents the receipts whereof they do hereby acknowledge and Confess have granted bargained Sold aliened and confirmed and by these presents do grant bargain sell alien and confirm unto the said Thomas Harris a certain lot or parcel of land lying and being in the County of Botetourt being a part of a tract of Forty Two acres conveyed by William N. Anderson and wife by deed bearing date the 1st day of January 1853 Containing by Survey one acres and three Eights, and bounded as follows to wit.  Beginning at a black oak and hickory corner to Susan Biglen and George Mangus and runneth thence with a line of Susan Biglen's land. S 73 W 20 Poles to a large fat Rock on the East side of Susan Biglens Spring branch, thence N 22 1/2 W 10 1/2 poles down near said branch and crossing the tilthammes branch at 10 poles to a white oak on the north side of the branch N 71 E 22 poles down near the north side of said branch and crossing the same below the turn of the branch, and crossing the Road to a stone on or near said Mangus's line and with the same S 2 1/2 W 11 3/4 poles crossing a small branch and two Roads to the beginning to have and to hold the said lot of parcel of land with all singular the appurtenances thereunto belonging unto the said Charles Thomas Harris and his heirs forever, and the said Jacob Haymaker and wife for themselves and their heirs covenant that they will arrant generally in fee simple the lot or parcel of land hereby Conveyed witness the following Signature and Seals.

     We Jacob Peters and James M. Figgat justices of the peace for the County of Botetourt of the aforesaid in the State of Virginia do hereby certify that Jacob Haymaker a party to a certain deed being date the 10th day of February 1853 and thereto annexed personally appeared in our County aforesaid & acknowledged the same to be his act & deed, and deserved? us to certify the said acknowledgement to the clerk of the County Court of Botetourt in order that said deed may be recorded.
And we do further Certify that Christina Haymaker wife of Jacob Haymaker parties to the deed aforesaid also personally appeared before us at the same time and place, and being examined by us priorly & apart from her said husband, and having the deed aforesaid fully explained to her She the said Christina Haymaker acknowledged the same to be her act and deed and declared that she had willingly signed sealed and delivered the same & that she wished not to retract it. 

Given under our hands this 10th
day of February 1853

At Botetourt December Court 1857

     This plat & report of survey of a tract of delinquent land of Michael Wolf, purchased for delinquent taxes by Charles Harris, was presented to Court, examined, Confirmed and ordered to be recorded.

Where as by an act passed by the General Assembly of Virginia on this 10th day of March 1832 concerning delinquent and forfeited lands and providing for the sale of lands returned delinquent for the non-payment of taxes.  It is made the duty of Clerk of each County, to execute a deed to the purchaser of any land or lot sold under this provision of the above recited act, after the expiration of the time allowed  by law for the redemption thereof & whereas Joseph H Pitzer Deputy for Rufus Pitzer late Hiegh Sheriff for Botetourt County made out and witnessed to the Clerks Office of the County Court of Botetourt a list of lands and lots sold by him in the said County on the 8th day of October 1853 for the non-payment of the taxes due thereon from which list it appears that a certain tract or parcel of land containing two hundred acres (200 acres) being land charged on the commissions books and the records of said County of Botetourt in the name of Michael Wolf with a tax of One dollar and seventeen cents for the years previous to 1850,  was regularly sold for the taxes due thereon and that Charles Harris became the purchaser thereof at the price of One dollar and sixty cents for the said two hundred acres as aforesaid for which said sum and the expenses attending the sale, the said Charles Harris has produced the Sheriffs receipt amounting in all to the sum of $1.60 cents as aforesaid.  And the said Michael Wolf and all other persons having failed to redeem said land within two years from the date of sale, the said Charles Harris had the same surveyed on the 12th day of September 1857 and a report made by Charles Aunspaught the surveyor of Botetourt County to the Court of Botetourt County verifying the Miles? and bounds thereof which said report and Certificate of survey were ordered to be recorded by an order of said Court entered at the December Term 1857 from which report of survey said tract measures 200 acres.  And the said Charles Harris having applied to the Clerk of Botetourt County Court to make a deed to him conveying said land.  This deed therefore made in presence of the premises on the 31st day of December 1857 between Ferdinand Woltz Clerk of the County Court of Botetourt of the one part and Charles Harris of the other part Witnessed that in consideration of the premises as will as of the sum of One dollar to him in hand paid the said Ferdinand Woltz Clerk as aforesaid doth grant unto the said Charles Harris with special Warranty the entire tract of land herein before mentioned and which is more particularly deemed? in the report & certificate of survey made and returned by the surveyor as aforesaid as follows Viz:  
Surveyed for Charles Harris a tract of land which he bought as follows to Wit:  Beginning at two Chestnut Oaks & two hickories down and gone the beginning corner of said grant and thence S 36 W 88 instead of 68 poles which said Harris land to a large Rock on the side of the Mountain S 21 W 42 poles to three dead pines by a bank of rocks on top of the Mountain thence leaving said land S 17 E 30 poles to two white oaks S 14 W26 po to three Chestnut Oaks S 43 E 24 poles to two black oaks  S 19 E 40 po to two white oaks & a black oak S 29 E 30 po to two black oaks down and two white oaks added S 14 E 46 poles to a white oak and hickory on top of the Mountain S 9 W 40 poles to a dead black oak a black oak cut down and a hickory added on top of the Mountain corner to Richison's and with a line of his land S 70 E 4 poles to in a field near a large flat rock where six black oaks stood N 44 E 170 ples to two large Chestnut stumps in a field N 23 E 40 poles passing a marked Chestnut oak & black oak at 20 poles to a pine and a black oak, red oak, sourwood & chestnut sapling where said Grant calls for a stake and thence N 48 1/2 W 220 poles to the Beginning.  September 12th 1857.

This deed made this 4th day of September in the year of our lord one thousand eight hundred and fifty eight between Charles Harris and Mary his wife of the one part of Botetourt County state of Va. and John W Robinson of said county of the other part. Witnessed that the said Charles Harris & Mary his wife for and in consideration of the sum of two hundred dollars to them in hand paid by the said John W Robinson the receipt for the same is hereby acknowledged hath granted Bargained & sold and by these presents doth grant Bargains sell allien and confirm unto the said John W Robinson a certain tract or parcel of land containing thirty acres granted to the said Charles Harris by patent bearing date the second day of October eighteen hundred and fifty four lying in Botetourt County on the waters of Catawba creek and on the west side of the second knob of Tinker Mountain including what is called the knob rocks and bounded as follows, Viz; Beginning at a Chestnut Oak and Chestnut Oak and hickory fallen down by a path corner to to Edward McDonald's now Benj'n Faris's track of 140 acres and with the same S 43 W 40 po to a chestnut oak and two Spanish oaks by another path S 14 W 43 po to 4 chestnut oaks and path N81 W 41 to large chestnut stump in McDonalds field S 11 W 28? po to 3 chestnut stumps and six chestnut sprouts from from two of the stumps in a line on a ridge cornet to Samuel Brickey's land and with the same S 65 E 40 pl to two chestnut oaks on the west side of the mountain where a chestnut stood S 5 1/2 W 78 po dead red oak and a double chestnut oak & an ash added on a ridge and leaving Brickey's land an up the mountain W85 E 60 po crossing the knob Rocks at a forked pine at fifty po to a white oak and two chestnuts oaks on Hinderliters line and with the same W 45 W4 po to three chestnuts oaks corner to the same N12 W 24 po to 2 white oaks N 19 W 28 po to 3 pines near a great Bank of rocks N 20? E 42 po to a large rock on the north east end of the mountain N 35 E 78 po to 78? po to two chestnut oaks and a hickory added corner to Abraham Lemmons track of 16 acres end with a line of the same N 10 E 9 po to 3 chestnuts oaks on said line thence leaving the same N 61 W 17 po to 3 chestnuts oaks and a red oak on or near the last line of said McDonald's track and with same S 8 W 19 po the beginning with the appurtenances to have and to hold said track or parcel of land to the said John W Robinson his heirs and assigns forever and the said Charles Harris & Mary his wife from themselves their heirs executors administrators or assigns by these presents shall and will forever warrant and defend against the claim or claims of any other person or persons whatever in testimony whereof the said Charles Harris and Mary his wife hath hereunto set their hands and seals the day and year first above written.

     We Jacob G Sperry and Jacob Peters Justices of the peace in the county aforesaid, in the State of Virginia do hereby certify that Charles Harris a party to a certain deed bearing date the 4th day of September 1858 and thereto annexed personally appeared before us in our county aforesaid and acknowledged the same to be his act and deed, and ????? us to certify the said acknowledgement to the clerk of the county court of Botetourt in order that the same deed maybe recorded. We also do further certify that Mary Harris the wife of the said Charles Harris parties to the above mentioned deed hereto annexed personally appeared before us in our county aforesaid and being examined by us privately and apart from husband and having the said deed aforesaid fully explained to her she the said Mary Harris acknowledged the same to be her act and deed and does that she willingly signed sealed and delivered the same and that she wished not to retract it. Given under our hands this 4th day of September 1858.

This Deed made this 18th  day of November in the year 1858 between Rebecca J. Mangus and Charles T. Harris witnessed, that in consideration of Twenty dollars the said Rebecca Mangus doth grant unto the said Charles T Harris a certain lot or parcel of land containing one acres lying in the County of Botetourt on the waters of Catawba Creek joining the land of Susan Bigler?, Jacob Haymaker, Isaac Haymaker, and said Harris being part of the land assigned to the said Rebecca J. Mangus in the division of the lands of her Father George Mangus died and the said one acre is bounded as follows to wit. Beginning at a rock in the road on said Harris line corner to said Mangus and with her line and the land of said Susan Bigler S 81 E 9 poles to a rock in said road by a bridge thence near lines N 1 1/4 W 18 2/3 poles to a rock N 81 W 9 poles to a rock on the old line which is also Jacob Haymaker's line and with the same S 1 1/4  E 18 2/3 poles passing Isaac Haymaker's corner and with his line and passing said Harris Corner and with his line to the beginning. and the said Rebecca Mangus covenants that the will warrant generally the lot or parcel of land hereby Conveyed. Witness the following Signature and Seal.

This  indenture made and entered into this Seventh day of March One Thousand Eight Hundred and Sixty Two by and between Charles T Harris and Martha Harris  his wife of the County of Botetourt State of Virginia of the one part and Rebecca J Mangus of the County of Botetourt and same State of the other part Witnessed that the said Charles T Harris & wife for and in Consideration of the sum of one hundred dollars and fifty dollars in hand paid by the said Rebecca J Mangus at or before the Sealing and delivery of these presents the Receipt whereof they do hereby acknowledge and confess have Granted bargained Sold aliened and Confirmed and by these presents do Grant bargain sell and confirm unto the said Rebecca J Mangus a certain lot or parcel of land lying and being in the County of Botetourt aforesaid on the waters of Catawba Creek a Branch of the James River joining the lands of Susan Bigler Isaac Haymaker and others and Containing by survey one acres and bounded bounded as follows to wit.  Beginning at a Rock in the road on said Harris line corner to said Mangus and thence with her line and the land of Susan Bigler  S 81 E 9 poles to a Rock in said Road by a Bridge thence new line N 1 1/4 W 18 2/3 Poles to a Rock  N 81 W 9 Poles to a Rock on the old line which is Jacob Haymaker's line and with the same S 1 1/4 W 18 2/3 poles passing Isaac Haymaker's Corner and with his line & passing said Harris Corner and with his line to the Beginning. To have and to hold said lot or parcel of land to the said Rebecca J Mangus her heirs or assigns forever & they said Charles T Harris and Martha his wife from themselves their heirs Executors and administrators the ???? of said Track or parcel of land and all the benefits & privileges thereunto  belonging to the said Rebecca J Mangus her heirs Executors administrators or assigns by these presents shall & will forever warrant & defend against the Claim or Claims of any other person or persons whatsoever In Testimony whereof the said Charles T Harris and Martha his wife hath hereunto set their hands Seals this day and year first above written.

Harris declares that she had willingly signed Sealed & delivered the same and does not wish to retract it and thereupon Said Deed is Admitted to Record.

This deed made this 16th day of September 1865 between Charles T Harris and Martha J Harris his wife of the first part and Thomas K Menifee of the second part, all of the County of Botetourt VA  Witnessed that in consideration of One Dollar, they the said Charles T Harris & Martha J his wife do grant unto the said Thomas K Menifee a certain lot or parcel of land containing by survey One and three eights acres (1 3/8) lying on the waters of Catawba in the County of Botetourt adjoining the lands of Jacob Haymaker, Susan Bigler and George Mangus's Estate, and is the same lot conveyed to the said C T Harris by Jacob Haymaker & wife by Deed bearing date on the 10th of February 1853 to which deed reference may be had for the meter and bounds of the property hereby conveyed. They the said Charles T Harris and Martha J his wife do covenant with the said Thomas K Menifee that they will warrant generally the above described property with the appurtenances to the said Thomas K Menifee.

Witnessed that in consideration of the sum of one dollar the said Charles T Harris & wife do grant unto the said Charles Harris a certain tract or parcel of land containing fifty acres lying & being in the County of Botetourt on the waters of Carvan Creek and by virtue of Land Office Treasury warrant No. 12474 was granted to the said Charles T Harris by the Common Wealth of Virginia the 30th April 1848 and bounded as follows, Viz; Beginning at 2 Chestnut Oaks on a hill side supposed to be a corner of Henderlighters land and runneth thence S 38 E 68 poles to 2 Pines a Chestnut Oak & Black Oak on the SE side of a ridge S 38 W 32 Poles to a red Oak & four small pines on the side of said ridge S 38 E 40 Poles crossing Brownfield path at 30 Poles to 2 pines and a Chestnut near another path N 50 E 60 Poles to 2 pines on the North side of the top of a ridge south of the branch north 17 poles crossing the branch at 10 poles to a locust Red Oak & Sourwood on the north side of the branch S 87 1/2 E 37 Poles to a gum & chestnut in a hollow N 13 E 40 Poles crossing the path at 38 poles to 3 pines near the same N 44 W 27 Poles to a Chestnut Oak & 3 chestnut Oaks from one root S 53 W 40 Poles to 2 small pines near  a blazed pine N 52 W 134 Poles to two single & a double Chestnut Oak by a large rock on the south side of the Mountain above Charles Harris's house S 45 W 2 Poles to a Hickory & Red Oak and thence S 20 E 64 passing a corner of Henderlighters land at 24 poles & with a line of the same crossing the branch to the Beginning.  With its appurtenances as they the said Charles T Harris & wife warrant generally the above described property to the said Charles Harris, witnessed the following signatures & seals.

Botetourt Co. to Wit,

     We James W Shuey and J G Sperry Justices of the County aforesaid do certify that Charles T Harris whose name is signed to a certain deed bearing date on the 16th Sept 1865 & hereunto annexed acknowledged the same before us and we do further certify that Martha J wife of the said Charles T Harris whose names are signed to the said hereunto annexed deed being by us examined priorly & apart from her said husband acknowledged the same to be her act & deed declares that she had willingly executed the same & that she does not wish to retract the same. Given under our hands this 11th day of October 1865.

This Deed from Charles T Harris & wife to Charles Harris having an internal revenue stamp to the amount of fifty Cents affixed thereto & cancelled was this day produced to me in the Office aforesaid and with the certificate of acknowledgement thereon written admitted by me to record.
