UNION DISTRICT

In the name of God Amen, I Benjamin Nix, of the District aforesaid - being of Sound & disposing mind and Memory, but weak in Body, and Calling to mind the uncertainty of Life, and being desirious to dispose of all Such Wordly Estate as it has pleased God to bless me with, do make and ordain this my Last Will, in manner following ( ie ) ---- I desire that all my Personal Estate ( with the Exception hereinafter made ) be immediately Sold after my decease, and out of the moneys arising therefrom , all my Just Debts & Funeral Expenses be paid ---- After payment of my Debts & Funeral Expenses , I Give to my Grandson John Clemmon Nix, A certain Track of Land & all the Buildings & Belonging thereto formerly occupied by my son John Nix decd. - , North of a Line which to be made beginning on the Branch West of the Sd. Premises & taking the Line of Fence nearest South on Sd. Plantation thence East with the Sd. Fence a direct course to the Branch on the East side of Sd. Premise ---------- I Give to my Grandson Mark Nix , my possessions on which I now Live together with all appertaining this to from the above Specified Now Line from each designated Branch down the mean duing of the Same to Tyger River & I also Give to his Mother Sarah Nix one Feather Bed & Furniture & 1 Teapot -------------- I Give to my Grandson William Nix all the Remainder of my Land / bounded by N. G. Holcombes Land & William Sparks Land and Tyger River --------------------- And Lastly, I do Constitute and appoint my Friends Jason Greer Esqr. & Hyram B Murphy executors of my Last Will & testament, in testimony where of I have hereunto Set my hand & affixed my Seal --------- this the Twentieth day of May 1836.

STATES FOR THE EASTERN DISTRICT OF ARKANSAS

Syllabus

The exercise of a preemption right under the Act of September 4, 1841, 5 Stat. 453, by an entry of one-quarter of a quarter section of land, was an abandonment of the right to enter under that act for the remaining three-quarters of that quarter section.

A person who, on the 8th March, 1870, had a title by patent to a quarter of a quarter section of land and lived in a house erected upon it, and cultivated the remaining three-quarters of the quarter section without title, did not reside upon the three-quarters so cultivated, within the meaning of c. 289, Acts of Arkansas, 1871, which gave persons then residing upon lands belonging to or claimed by the Cairo and Fulton Railroad Company, or its branches, the right to purchase them not to exceed 160 acres.

The facts which make the case are stated in the opinion of the Court.

MR. CHIEF JUSTICE WAITE delivered the opinion of the Court.

This is a suit in equity, brought by John B. Nix, the appellant, on the 2d day of May, 1879, enjoin the execution of a judgment in ejectment recovered against him by Thomas Allen the appellee, on the ___ of April, 1879, for the possession of the west half and the southeast quarter of the northeast quarter of sec. 30, T. 15 S., R. 28 E., in Arkansas, and to obtain a conveyance of the legal title to the property, on the ground that Allen holds it in trust for him. The case shows that in 1846 Sarah Nix, the mother of John B. Nix, then a minor residing with her, took possession of the whole of the northeast quarter of the section. Mrs. Nix had all the legal qualifications of a preemptor, and while in possession built a house on the northeast quarter of the quarter section, and cleared and cultivated a portion of the land on that and on each of the other quarters of the quarter. The principal part of the clearing and cultivation, however, was on the quarter where the house stood.

On the 9th of February, 1853, Congress passed an act granting lands to the State of Arkansas to aid in building a railroad from a point on the Mississippi, opposite the mouth of the Ohio, to the Texas boundary line near Fulton, in Arkansas. 10 Stat. 155. The lands now in question lie within the limits of that grant, and were withdrawn from entry on the nineteenth of May, 1853, but the granting act contained the usual reservation in favor of preemption settlers.

On the 22d of April, 1853, Mrs. Nix made and filed her declaratory statement and proof for the preemption of the whole of the northeast quarter of the section. In her statement she fixed the first of April, 1853, as the date of her settlement on

the lands. At the time of filing the statement and proof she made no payment.

On the 27th of March, 1854, Congress passed the following "Act for the relief of settlers on lands reserved for railroad purposes." 10 Stat. 269.

"That every settler on public lands which have been or may be withdrawn from market in consequence of proposed railroads, and who had settled thereon prior to such withdrawal, shall be entitled to preemption at the ordinary minimum to the lands settled on and cultivated by them, provided, they shall prove up their rights according to such rules and regulations as may be prescribed by the Secretary of the Interior, and pay for the same before the day that may be fixed by the President's proclamation for the restoration of said lands to market."

On the 31st of March, 1854, Mrs. Nix made a preemption cash entry of the N.E. 1/4 of the N.E. 1/4 of the section, and a patent for this tract was issued in her name under that entry on the 10th of December, 1874. In her affidavit to support the entry, she fixed the first of April, 1853, as the date of her settlement, the same as in her original declaratory statement. It is now claimed that this entry was not her own act, but the testimony shows unmistakably that it was. She was feeble at the time and unable to go to the land office herself, but the business was done for her by Benjamin Nix, her nephew and the guardian of John B. Nix, who furnished the money to make the payment from funds in his hands as guardian. Mrs. Nix had no means of her own, and the fifty dollars which was required to pay for the forty acres was all that John B. had. Neither the mother nor the son was able to buy more than was then entered. On the 28th of September, 1858, Mrs. Nix conveyed the land she entered to John B., who arrived at full age during the year 1857.

Mrs. Nix and John B. Nix lived together in the house on the N.E. 1/4 of the quarter section until her death in 1863, and John B. Remained there down to the time he filed the bill in this case. While occupying the northeast quarter of the quarter they have used and cultivated some part of the other quarters,

but the actual residence, both of the mother and son, has always been on the part that was entered by and patented to the mother. Mrs. Nix left other heirs besides John B. Nix, some of whom were living when this suit was begun.

On the 16th of January, 1855, the State of Arkansas transferred the grant of Congress, so far as it related to the lands in dispute, to the Cairo & Fulton Railroad Company,

"subject to all the conditions, limitations, and restrictions contained in the act of Congress aforesaid, and in the act of Congress entitled 'An act for the relief of settlers on lands reserved for railroad purposes,' approved March 27, 1854."

The act by which this transfer was made contained the following provision:

"That citizens or heads of families, being settlers or occupants previous to the passage of this act on the land herein transferred to the said Cairo & Fulton Railroad Company, shall each be entitled to a preference right of entry of any legal subdivision of land not exceeding one hundred and sixty acres, which shall be upon such legal subdivision as will include the residence of the said settler, which preference right shall be at the price of two dollars and fifty cents per acre, which preference right of entry shall exist from the passage of this act, and for three months after notice has been given for three successive weeks in a newspaper published in the City of Little Rock, that the said land is in market."

Laws of Ark. 1854-55, p. 150 § 1.

This provision of the act of 1855 was repealed on the 26th of November, 1856, and the following enacted in its place:

"SEC. 2. Every person who, on the 9th of February, 1853, occupied, by residence and cultivation thereon, any tract of land comprised in the grant made by virtue of, and under the provisions of, such act of Congress of February 9, 1853, may purchase from said Fulton & Cairo Railroad Company at two dollars and fifty cents per acre, the legal subdivision of such land as shall include his residence and actual improvements, not to exceed one quarter section, by complying with the following conditions:"

"SEC. 3. Such claimant shall, within three months after said lands are selected and confirmed to said company, and a list or

plat thereof filed in the recorder's office in the county in which such lands may lie, file with the auditor of state his own affidavit, accompanied by the affidavits of two disinterested freeholders of his county, describing the land claimed by legal subdivisions, proving the fact of such occupancy, residence, and cultivation upon such legal subdivisions with a view to actual cultivation and settlement, before the day above specified, said company may, by giving reasonable notice to such claimant, appear before the auditor and controvert the facts set forth in such affidavits, and the auditor may swear witnesses, hear proof, and, for cause shown, set aside any such claims, provided that no such claim shall be set aside for misdescription, or error in form only, founded on mistake; but on affidavit showing such mistake, reasonable time may be given for the filing of corrected proof."

"SEC. 4. Said claimants shall, after three months, or as soon thereafter as said company shall be in a condition to make title, pay to said company the consideration for said land as hereinbefore provided, whereupon he shall be entitled to receive from said company a deed for the same, but in case of failure to file said proof, or pay said consideration money within the respective time specified, the right to make such purchase shall cease."

On the 1st of February, 1859, another act was passed on the same subject, which contained this provision:

"SEC. 3. Be it further enacted that every person who, on the 1st day of November 1858, resided on or cultivated any improvement on any of the land comprised in the grant made by virtue of the act of Congress approved February, 9, 1853, may purchase from the said Cairo & Fulton Railroad Company at two dollars and fifty cents per acre, one hundred and sixty acres, which may include the actual residence or the farm of such person, as he or she chooses to elect, by complying with the conditions prescribed by an act passed by the last General Assembly of this state, entitled 'An act to amend an act to aid in the construction of the Cairo and Fulton Railroad,' approved January 16, 1855, which act was approved November 26, 1856, and provided further that until such default

mentioned in said act, the owners of such improvements shall be entitled to use and occupy the same free of rent or charges."

And, finally, on the 28th of March, 1871, the following was enacted:

"SECTION 1. That where any settler, who, on or before the eighth (8th) day of March, 1870, was residing and made improvements on the lands belonging or claimed by the Cairo and Fulton Railroad Company, or its branches, shall have the right to purchase the same, not to exceed one hundred and sixty acres, under the legal subdivision of said lands, and including the homestead and improvements of such settler at not exceeding the rate of two dollars and fifty cents ($2.50) per acre, in preference to any and all other persons, from and after the passage of this act, and for three (3) months after said land has been advertised according to law."

"SEC. 2. That any person authorized to purchase land under the provisions of section one(1) of this act, tender to the authorized agent of said Cairo and Fulton Railroad Company at the principal office of said company, or at the principal office of the branches of said Cairo and Fulton Railroad Company, and to the authorized agent thereof, the amount of the purchase money of said land, and demand a title therefor, or his preference right thereto shall be barred."

On the 13th of July, 1857, the Commissioner of the General Land Office certified these lands with others to the Cairo and Fulton Railroad Company under its grant, and on the 18th of February, 1858, the company filed in the recorder's office of Lafayette County, which then embraced the lands in dispute, a list of all lands in that county "selected and confirmed to that company."

On the 15th of April, 1874, the land commissioner of the railroad company published in the Arkansas Daily Gazette a notice that the lands of the company between Little Rock and the Texas line would be sold at the office of the company on and after June 16, 1874, reserving, however, mineral lands and lands through which the road ran. The road went through

the northeast quarter of this section. The Gazette was a newspaper published at Little Rock, and designated by the governor of the state for the publication of official notices, and the advertisement was continued from the 15th of April to the 15th of June, 1874. The notice also called on all actual settlers who had not made application to purchase to do so before the day of sale. On the 28th of July, 1874, John B. Nix went to the land commissioner of the company and claimed the right to purchase the northeast quarter of the section at $2.50 an acre. He at the same time tendered $400 in payment of the purchase money, and demanded a conveyance. The commissioner would not admit his right to buy, and refused his tender.

On the 14th of May, 1875, the company sold and conveyed the lands in dispute, being the one hundred and twenty acres, to Thomas Allen the appellee, and on the 23d of the same month he began a suit against Nix to recover possession.

On the 19th of June, 1878, while this suit was pending, John B. Nix made application to the land officers of the United States, as heir at law of Sarah Nix, to purchase the whole northeast quarter under the preemption claim of his mother. At the same time he deposited with the register of the land office three hundred dollars "to pay out his mother's preemption." This application was refused.

Upon these facts the court below dismissed the bill, and this appeal was taken from a decree to that effect.

The claim of the appellant is 1, that he has a complete equitable title to the lands under the acts of Congress as a preemptor, and 2, that if this fails, the laws of the state gave him the right to purchase in preference to all others, and that he fully complied with all the requirements of those laws to complete and perfect his right of purchase before Allen the appellee, got title. These will be considered in their order.

1. All the rights of preemption which the appellant sets up originated with his mother. In his application to enter the lands, made in 1878, he expressly bases his claim on her original settlement, and his inheritance from her. He does not pretend that he made a settlement himself before the rights of

the railroad company accrued. In fact, he could not have made such a settlement, because he remained a minor until 1857, and the lands were withdrawn from market in 1853, on account of the railroad grant. Only persons over the age of twenty-one years could become preemption settlers. Such is the express provision of the preemption act. If, then, his mother, had she been alive, could not have made a preemption entry in 1878, he could not.

The settlement and claim of Mrs. Nix were made under the Act of September 4, 1841, 5 Stat. 453, and in that statute it was expressly provided (sec. 10) that "no person shall be entitled to more than one preemptive right by virtue of this act." When, therefore, Mrs. Nix, on the 31st of March, 1854, made her preemption entry of the northeast quarter of the quarter section on which she settled, and as to which she filed her declaratory statement in 1853, she, in law, abandoned her settlement on the other three-quarters of the quarter section for the purpose of preemption, and surrendered all the preemption rights she ever had in them. This is clearly shown by the provision in sec. 13, "that before any person claiming the benefit of this act shall be allowed to enter such lands," he shall make oath "that he has never had the benefit of any right of preemption under this act." The right of preemption is the right to enter lands at the minimum price in preference to any other person, if all the requirements of the law are complied with. The prior settlement, declaratory statement, and proof are not the preemption, but only the means of securing the right of preemption. By entering the forty acres in 1854, Mrs. Nix exhausted the one right of that kind which the law secured to her, and she could not claim another. She could have entered the whole 160 acres at the time if she wished to, and had the money, but such an entry would have required two hundred dollars, and she had but fifty. The fifty would pay for forty acres, and so she bought that and gave up the rest. The law made no provision for entering a part of the quarter section at one time and saving the right to enter the remainder at another. The averment in the bill therefore that the payment of the fifty dollars at the time of the entry of the

forty acres was "intended as a part payment of the whole," cannot be true. The law permitted nothing of the kind.

The evident purpose of the Act of March 27, 1854, was to aid preemptors. It gave the designated settlers the right of preemption -- that is to say, a preferred right to buy the lands on which they had settled under the preemption laws at the ordinary minimum price. If a settler had once had the benefit of those laws, this statute gave him no new rights. He could not be a preemptor, because he could not take the necessary oath. Consequently, when Mrs. Nix, on the 31st of March, four days after the Act of March 27 was approved, made her preemption entry of the forty acres, she exhausted all her rights under the act of 1854, as well as those under the act of 1841. It follows that the appellant has no right under the various acts of Congress which are relied on.

2. The Arkansas act of 1855, giving settlers and occupants a preference right of purchasing the lands thereby granted to the railroad company at $2.50 an acre, was repealed by the Act of November 26, 1856, before either the appellant or his mother attempted to avail themselves of its provisions. The act of 1856 required claimants to file with the auditor of state certain affidavits within three months after the lands were selected and confirmed to the company, and a list and plat thereof filed in the recorder's office of the county in which the lands were situate. The list and plat of these lands were filed in the proper recorder's office on the 13th of July, 1857. No affidavits such as the act required were ever filed by the appellant or his mother in the office of the auditor of state, and for this reason, in accordance with the express provisions of § 4, "the right to make such purchase" ceased as long ago as the year 1857. The act of 1859 did not inure to the benefit of the appellant or his mother for the same reason. The privileges of that act could only be secured "by complying with the conditions prescribed" in the act of 1856.

This reduces the claims of the appellant to such as he has under the act of 1871. That act grants the privilege of a preference purchaser only to a

"settler who, on or before the 8th of March, 1870, was residing and made improvement on the lands

belonging to or claimed by the . . . railroad company,"

which he desired to buy. This appellant, on the 8th of March, 1870, resided on the northeast quarter of the quarter section. That land the company neither owned nor claimed. It was entered and paid for by Mrs. Nix in 1854, and she deeded it to the appellant in 1858. His title to that part of the quarter section is not disputed, and his residence has always been there. He cultivated parts of the other quarters of the quarter on the 8th of March, 1870, but he did not reside upon them or either of them. Under the circumstances, his residence was, in law, confined to the land he owned. Seeing this difficulty, he applied for the purchase of the whole quarter section, basing his claim apparently on the original settlement and declaratory statement of his mother for the preemption of that tract. In this way he sought to connect his residence upon the northeast quarter with his occupation of the other quarters. That he cannot do, as by the entry of the northeast quarter his mother separated her residence from the rest of the quarter section, and he has done nothing since to change that condition of things. It follows that the appellant is not entitled to the privileges of the act of 1871, and his claim, both under the acts of Congress and those of state, has failed. This makes it unnecessary to consider whether the act of 1871 is constitutional. Good or bad, it is of no use to him. The same is true of the claim that the company has no title because at the time the grant was made the land in question was occupied by Mrs. Nix as a preemptor. The appellant can recover only on the strength of his own title. If he has no title, it is a matter of no importance how weak that of his adversary may be.

Decree affirmed.

     Out of the long ago comes the
Story of Sarah Nix, a courageous
Pioneer, who made the first settle-
ment inside the corporate limits
of Texarkana. As Sarah Howard
She was born in 1800 in Union Dis-
trict South Carolina, where her
father had moved his family from
Buncombe County, Virginia, during
the latter part of the 18th Century.
In 1816, she was married to John
C. Nix and that she was the
mother of seven children, all girls
except the youngest, John B. The
first Child died six months after
birth, but the others lived to be
grown and married. Mrs Nix be-
came a widow when John B. was
but three days old, which was on
the 30th of November 1836.
Some years later two of her
daughters had married. One of
them was the son of her cousin
William Nix, and the other was
with Benjamin White xxxxxxxxx

And as Sarah Nix wanted to be
near her daughters she decided
to migrate with them. Soon a
company of five families, with 13
wagons, started overland to Tex-
as, in the year of 1845. The Party
consisted of the families of Mrs.
Nix, William Nix, Benjamin White,
Samuel and Jerry Bobo. After a
long and tedious journey, beset
by much trial and sickness, they
at length arrived at the present
site of Texarkana on Feb. 14,
1846. A considerable distance still
lay between them and the place
of destination. The season was
growing late and they realized
that they would be unable to grow
a crop after getting to Houston
county, so they decided to stop
here and grow a crop, then go on
to destination the following au-
tumn. Sarah Nix stopped the first
season at what was then known as
the Dr, Birmingham place. Ben-
jamin Nix rented farming lands
from Eli Moores. Samuel Bobo
worked around from place to place
at first, but later made a settle-
ment on the Sulphur river, which
became known as Bobo’s Ferry.
Jerry Bobo settled about 12 miles
west of Texarkana at first, but
finally moved across the Sulphur
River into what later became Cass
County, Texas. He died soon after-
ward.
The Union Army, en route to
Mexico, passed along the Boston
road, and John B. Nix, then 9
years of age sold his crop of water-
melons to the soldieries. In the fall
of 1846, Mrs. Nix looked around
for a suitable site for a home-
stead, and selected section 39,
township 15, range 28, in the pres-
ent Miller county Arkansas. Soon
a small house , made of pine poles,
was erected. Mrs. Nix lived there
until John B. was grown, and then
he built a hewed log house for her.
When she reached this part of
The country, Mrs. Nix had little
money, and depended on obtain-
ing her home by homestead or
public entry. In 1853 congress made
a public grant of lands to the
Cario and Fulton railroad, to aid
Them in building a road, and all
lands were withdrawn from the
market, however, actual settlers
already on a settlement were
permitted to file claims in the land
office to perfect titles by payment
of the government price when the
Xxxxxxxxxxxxxxxxxxxxxxxxxx

Her claim according to law in
1863, When the railroad came to
Texarkana in 1873, the charter
had passed from the Cairo and
Fulton to the Iron Mountain, and it
was not possible for her to obtain
a perfect title under 20 years from
the time when she filed her claim
at the land office in Washington
Ark. When John B. Nix was an infant,
his grandfather in South Carolina
made a deed of gift to forty acres
of land in the state, which was for
his grandson. The land could not
be sold until John B. was old
enough to select his own guardian,
which he did in 1852. His brother-
in-law, Ben Nix, was chosen, and
he in turn, employed a lawyer in
South Carolina to attend to the sale.
The property was worth $1200. It
was sold and the lawyer sent Nix
a check for $50, which was cashed
by Cuily and Edwards who had a
short time before, begun a mer-
cantile business at Rondo. In his
anixiety to secure a homes for his
mother, Nix requested that the
money be put on deposit in the land
office at Washington Ark., to be
held in trust until such time as it
could be used in the purchase of
their home. The $50 was all he
ever received from the sale of the
land in South Carolina. The gov-
ernment held that money in trust
for 20 years, under pledge to keep
Mrs. Nix’s claim in trust until such
time as she could be allowed to
take a full and final payment, but
eventually the government com-
pelled her to accespt a title to only
one-fourth of the file claim, on the
plea that she had paid for that
amount at a time when the gov-
ernment denied her her right to
make purchase at all. Sarah Nix
braved the trails of frontier life,
and had endured the hardships
that went with the making of a set-
tlement in a wilderness country.
She had traveled hundreds of miles
overland, in the midst of high wat-
ers, with but few facilities for
crossing them, endured the discom-
forts of winter and sickness to
open up a new home for herself
and her children, yet, through a
plea that was justifiable on Mrs.
Nix’s failure to comply with red
tape requirements, much of her
property was taken from her. John
B. Nix made an outstanding fight
to secure a just settlement, and
the money for his fight was earned
by hard arduous labor by his
blacksmith shop which was at that
time situated near the present site
of the water works on East Ninth
Street. Finally he realized that the
fight was hopeless, and submitted
to the ruling.Mrs.
Nix remained a widow to
the end of her life. When in her
63rd year, an accident caused her
death as she rode horseback. She
was on her way to visit her daugh-
ter. Mrs. Nathan Jackson, when
rain began falling. As she en-
deavored to open her umbrella the
umbrella the horse became fright-
ened and ran away. When the ex-
cited animal brushed under a
slooping tree, Mrs. Nix was fatally
injured. She was found and cared
for, but lived only a short time
three of her daughters, who were
single when she came to this part
of the country, married, One became
Mrs. N. B Thomas, another
Mrs. Rodger Watson, and the third,
Mrs. Nathan Jackson, John B.
Nix marred and had four daugh-

Crow, Mrs. Julia Tullus, and Mrs.Martha E. McDonal, S. R. McDonald, who married Martha E. Nix, was Texarkana’s first machin-ist of importance. He established the Twin City Foundry and Machine Company, which is now operated by his sons, Charles P. and Sam Jr. Other sons and daughters of the McDonalds are Douglas, Allen Idele, Chris, Clarence, Lofton, of Shrevport, and Doris, Mrs. P. O. Baxter.
Sam McDonald married Ethel
Williams, and they have a daugh-
ter, Martha J. and a son William
Howard (the Howard is in honor of
the family of Sarah Nix) Charles
P. married the former Gertrude
Slaughter, and they recently cele-
brated their 35th wedding anniver-
ary. Many years have passed
since the widow Nix and her fel-
low pioneers drove their wagons to
what is now Texarkana. At that
time they thought their stay was
but for a season, but they remained
to help blaze the trail for a bright
and prosperous future for a proud
city. There were no - Flowersy
beds of ease in the frontier life of
Sarah Nix. She knew hard work,
trails, and disappointments, but
she walked tall in the sum, fear-
less, indonitable, honorable. And
so 102 years later, we salute the
arrival in Texarkana of Sarah Nix,
the courageous pioneer who made
the city’s first settlement.

[Notes from Mike: Polly's mother Sarah, came to Bowie County Texas in the wagon train of, Benjamin White, in 1846, her only son John Benjamin C Nix, who frequently went by Benjamin, was also in the group. Below I present a story of the Journey as shared by our descendants, from my own research into the family I have expanded and enhanced the story.]

"Evidently, the whole family did not make the move from South Carolina to Texas together. One of Elias WHITE’s older brothers, Stephen WHITE, born 1786 had moved to Houston County, Texas in January 1836, and the oldest son of Elias White, Benjamin WHITE had planned to go there, where Stephen WHITE owned 5615 acres in 1840. A wagon train of five families in thirteen wagons reached the site of Texarkana and decided to raise a crop before going on to Houston County and ended up staying in Bowie County. The five families in this group were: (1) Benjamin J. and Polly NIX WHITE and their three children, (2) Hester and Jeremiah [Jerry] BOBO and their children, (3) Sarah and Benjamin NIX and their children, (4) Sarah HOWARD NIX (the mother of Polly NIX WHITE and Sarah NIX (wife of Benjamin NIX) and her younger children, and (5) the family of Samuel BOBO. The journey was described as long, tedious and fraught with much trial and sickness. 

[Notes on the above paragraph, from Mike White:  
1. 'Sarah and Benjamin' is a mistake, Ben Nix was about 11 years old and would have arrived with his mother Sarah HOWARD, Ben or John B C Nix, later married Nancy Ann Akin, had many children and secondly, Eleanor Sutton Herring. The correct statement would be " Sarah [Howard] Nix arrived with her Son Benjamin Nix... 

2. I have no evidence that Benjamin White's middle name was Jason or Jackson.

3. Jeremiah Bobo was dismissed from the the Padgett's Creek Baptist SC, Nov 15th, 1845,
    this indicates he may have been in the 1st migration, in Ben's wagon train. 

4. Elias & Anne White along with Samuel Harlan were dismissed from the Lower Fairforest Baptist Church Oct 24th, 1846, lending support that they may have arrived later in Bowie County, note that Samuel Harlan is dismissed, it didn't say with wife... but they had to have been married as Julia was born 1845...Green Bobo was dismissed Oct 1846 from the Padgett's crk Baptist in Union Co and brother Lewis Bobo, in December, so it is my opinion that these two traveled in the wagon train of Elias and Anne White, along with Samuel & Susan [White] Harlan, arriving in 1847, when Elias first appears on the Poll Tax]. 

Benjamin WHITE rented farming lands from Eli MOORES. Samuel BOBO worked from place to place at first but finally settled on the Sulphur River at a place later know as BOBO’s Ferry. Jerry BOBO settled twelve miles west of Texarkana at first but finally moved across the Sulphur River into what later became Cass County. Sarah NIX stopped the first season at a place known as Dr. BIRMINGHAM’S place. She made a small house of pine poles. When her youngest child and only son was grown, he built a hewed log cabin for her.

[Note from Mike White: Samuel & Jeremiah Bobo were the sons of Solomon Jr & Elizabeth [White] Bobo, Elizabeth the aunt of Benjamin White, daughter of Robert Sr. & Milly [Whitehead] White. Also, in Bowie Co TX were brothers Green, Lewis Bobo, I am not sure when they arrived, Green & Lewis were probably with Elias. ]

All of this information was given to me by Mrs. Emma Lee PHILLIPS of Maud, Texas and from a book: White, Merrill, etc. The Lineage of Perry Merrill White Jr. M.D. by Katherine Freeman WHITE. There are many pictures of family members and much more about the family available in the book. The new Boston Genealogical Society is adding this book to the Genealogy Department of the New Boston Library."

[Note from Mike White:  Mrs. Emma Lee Phillips passed away 17 Feb 2003, in Texarkana, she is buried at the Chapelwood Memorial Gardens Bowie Co TX, Emma was born 1903, the daughter of Charles T & Elizabeth [Holley] 'Addie' White, Charles the son of  Thomas M & Marthia [Harris] White, Thomas the son of Ben & Polly [Nix] White].

[As a hint of proof that the family had indeed, originally, intended to migrate to Houston Co TX, after 1850,
we find Lewis Bobo, living in Houston Co TX, married and now with Children, he served in several units
during the Civil War, and appears to have died in the war between the states. ]

Vera Smith Spears book 'The Fair Forest Story', states 'The Nix or NICKS name dates back to 1274 in English History. Families by the name were living in Bute County NC in the early 1760's. Josephy Nix had a grant of land in Bute Co on Sandy Creek NC Sep 1764.

Nix's Ford (named after this family) was an early crossing of Tyger River in Union County, SC. It is found in several deeds for land in the county. James W Cooper mentions it in his letter of August 1859. (Letter on Robert White Jr's Web Page). 

Benjamin, William, John Nix (Brothers), were soldiers in colonial, Brandon's Regiment. It seems that William Nix came under the influence of Rev Henry Holcombe during the war and became a Baptist minister. William Nix made a will Aug 18 1836 and mentions the following: grandsons, John Clemmon Nix, Mark, William also mentioned the fact that the father, John Nix, was deceased; his daughter-in-law, Sarah Howard Nix. Sarah Nix was a daughter of Avery and Mary Howard. Avery Howard was a son of Obediah Howard, who was one of the missionaries to the Fair Forest area. Sarah Nix made a request to administer the estate of her husband, John Nix, Feb 22, 1835, (This request was read at Fair Forest (Union Co SC), by Rev Thomas Ray. Feb 22, 1835).

In the name of God Amen, I Benjamin Nix, of the District aforesaid - being of Sound & disposing mind and Memory, but weak in Body, and Calling to mind the uncertainty of Life, and being desirious to dispose of all Such Wordly Estate as it has pleased God to bless me with, do make and ordain this my Last Will, in manner following ( ie ) ---- I desire that all my Personal Estate ( with the Exception hereinafter made ) be immediately Sold after my decease, and out of the moneys arising therefrom , all my Just Debts & Funeral Expenses be paid ---- After payment of my Debts & Funeral Expenses , I Give to my Grandson John Clemmon Nix, A certain Track of Land & all the Buildings & Belonging thereto formerly occupied by my son John Nix decd. - , North of a Line which to be made beginning on the Branch West of the Sd. Premises & taking the Line of Fence nearest South on Sd. Plantation thence East with the Sd. Fence a direct course to the Branch on the East side of Sd. Premise ---------- I Give to my Grandson Mark Nix , my possessions on which I now Live together with all appertaining this to from the above Specified Now Line from each designated Branch down the mean duing of the Same to Tyger River & I also Give to his Mother Sarah Nix one Feather Bed & Furniture & 1 Teapot -------------- I Give to my Grandson William Nix all the Remainder of my Land / bounded by N. Yes, I believe that Benjamin Nix was -most likely - a brother of my 4X Great Grandfather, Joseph William Nix born
Union , SC abt 1761 (Some tree's reflect a birth yr 1770) . My line migrated from SC to Gwinnett, GA and finally settled
in Randolph, AL, where Joseph W. Nix died in 1822.

My research shows their father was Ambrose Joseph Nix (1725-1800) who was born Lunenburg, VA.
But, I have been looking for clues to confirm these relationships / dates etc. And this is how I stumbled upon the link
to Benjamin Nix and his line descended to John C. NIX.

I wasn't sure if my line was linked with Benjamin's, at first. But the more digging I have done, I have found clues to
support a relationship. One such clue, is the fact that Joseph W. Nix married Rebecca Ann White. Also, my 3×Great
Grandfather, Jeremiah Nix (son of Joseph W. Nix) had a daughter, Mary Polly Nix (1812-1880) who married James
Tinsley White. And the Benjamin Nix line has the Mary Polly Nix-White marriage as well. I have not been able to put
together the connection between James Tinsley White and Benjamin White, if there is one , yet.

Nix's Ford (named after this family) was an early crossing of Tyger River in Union County, SC. It is found in several deeds for land in the county. James W Cooper mentions it in his letter of August 1859. (Letter on Robert White Jr's Web Page). 

Benjamin, William, John Nix (Brothers), were soldiers in colonial, Brandon's Regiment. It seems that William Nix came under the influence of Rev Henry Holcombe during the war and became a Baptist minister. William Nix made a will Aug 18 1836 and mentions the following: grandsons, John Clemmon Nix, Mark, William also mentioned the fact that the father, John Nix, was deceased; his daughter-in-law, Sarah Howard Nix. Sarah Nix was a daughter of Avery and Mary Howard. Avery Howard was a son of Obediah Howard, who was one of the missionaries to the Fair Forest area. Sarah Nix made a request to administer the estate of her husband, John Nix, Feb 22, 1835, (This request was read at Fair Forest (Union Co SC), by Rev Thomas Ray. Feb 22, 1835).

Yes, I believe that Benjamin Nix was -most likely - a brother of my 4X Great Grandfather, Joseph William Nix born
Union , SC abt 1761 (Some tree's reflect a birth yr 1770) . My line migrated from SC to Gwinnett, GA and finally settled
in Randolph, AL, where Joseph W. Nix died in 1822.

My research shows their father was Ambrose Joseph Nix (1725-1800) who was born Lunenburg, VA.
But, I have been looking for clues to confirm these relationships / dates etc. And this is how I stumbled upon the link
to Benjamin Nix and his line descended to John C. NIX.

I wasn't sure if my line was linked with Benjamin's, at first. But the more digging I have done, I have found clues to
support a relationship. One such clue, is the fact that Joseph W. Nix married Rebecca Ann White. Also, my 3×Great
Grandfather, Jeremiah Nix (son of Joseph W. Nix) had a daughter, Mary Polly Nix (1812-1880) who married James
Tinsley White. And the Benjamin Nix line has the Mary Polly Nix-White marriage as well. I have not been able to put
together the connection between James Tinsley White and Benjamin White, if there is one , yet.
