Freeing of a Man 1805 -- Bird Murphy

This entry was in the Union Co. SC Deed abstracts Vol II 1800-1811 [1769-18110 by Brent Holcomb. (P.119)

"H, 333-334 -- Bird Murphy of Union District according to an act of assembly of the state for the emancipation of slaves and provided by a Certificate had and obtained before a Justice of the Quorum and five free holders, do set free a Negro man named George about 35 years old, five feet, ten inches high, 19 Dec 1805. Bird Murphy (LS), Wit: Joshua Thomas, And'w Torrance. Recorded 24 Dec 1805.

We hereby certify upon the oath of Bird Murphy the owner of a certain slave named George that the said slave is not of bad character and is capable of gaining a livehood by hones means, 12 Dec 1805. Robert White, Mark Murphy, Wm. Ray, Rob't Boatman (X), Wm Woolbanks. Recorded 24 Dec 1805.

NOTE:  We have no way of knowing the circumstances or reasons for the action described below, slavery made its presence, in Union Co, SC around 1790, I would suspect many folks of this time were opposed to slavery in this area, as was demonstrated when many Quakers left Union, SC, for this very reason, to the free northern states.  The person's listed below are all related to the White's, by marriage; Murphy, Boatman, Ray, and even Woolbanks, which I suspect is Wilbanks. I have never found a record of our Robert White Sr. owning slaves, however, some of his children did, and many of his neighbors. It was subsistence farming until 1790, in response to the large plantation owners moving in, and to compete with them, many Union folks bought into the slavery concept.

Bird & Mark Murphy were brothers of Sion III, Robert Boatman was the son of Waterman Boatman and the brother of our Elizabeth who married William White, Wm Ray's daughter, Mariah Ray married William Bobo, "Singing Billy", son of Soloman Bobo Jr, and Elizabeth White Bobo.  Wm Wilbanks, connection is most likely down the Murphy line, where there is a John Wilbanks, haven't made a solid connection here yet, and Lastly, Robert White, almost surely our Robert Sr., as Robt Jr, was only 21 years old in 1805.

Bird Murphy was involved in Freeing of men before 1805:

his entry was in the Union Co. SC Deed abstracts Vol II 1800-1811 [1769-18110 by Brent Holcomb. (P.18):

"G, 161: We hereby certify upon the Examination of Jno Bailey the owner of a certain Negro man slave named Luke about the age of 25 years satisfactory proof has been given to us that the s'd slave is not of bad character and is capable of gaining a livelihood by honest means, 27 Feb 1801. Jno Martindale (LS), B. Bobo (LS), Wm. Woolbanks (LS), David Floyd (LS), Bird Murphy (LS), James Duncan (?) son of Alxr (LS)."

NOTE: James Duncan was the father of Bird Murphy's wife Charlotte Duncan.  David Floyd, may have been related down the Bailey and Murphy lineage, as there were some Floyd's, B. Bobo, not sure which Bobo.  Have found no Martindale's? Bailey's are mainly down the Murphy line.

 Cemetery notes and/or description:
Location and Historical information:

From Descendant, Dale Murphy

"The Cemetery is on the left on Bombing Range Road, 1/2 Mile after you cross Isaac's Creek. It cannot be seen from the road and needs to be cleaned. It is, 15 X 15 square, 40 to 50 yards off the road, with a 2 ft rock wall surrounding the cemetery.  I hung a new ribbon (Oct 30, 2015), at the road for other Murphy's to find."

"Mark and Holly Murphy are buried on what was their Property, Mark had accumulated over 334 acres (PURCHASED FROM MACGARITY AND ALEXANDER) of land east of Sion Murphy's property. The Sion Murphy Cemetery is 200 yards on the left on Bombing Range Road. The Mark Murphy Cemetery is about 1 mile east on Bombing Range Road".

Note:
Dale Murphy is trying to find out from the Sumter Forest Service, if he an cleaned up the cemetery area, and mark the path clearly off the main road.

"The National Forest Service purchased and confiscated deserted lands in the 1920's to form Sumter National Forest. Mark and Holly's sons had all left by 1845. I don't know who owned the property after Gideon Shands in 1845".

"The Cemetery is enclosed by 2 ft old Rock Wall.  It has been known by family tradition as 'Mark and Holly Murphy Resting Place'".

"I have documented Mark and Holly Murphy's Cemetery. I found a Land Transfer from Mark Murphy's Sons Simon P. Murphy and Emanuel Masters Murphy. The Land Was Sold To Gideon Shands in 1845".

Lewie Dunn added:
...I reread my Murphy book on Emanuel Masters, Page 72, state that Claude Sparks, who wrote the Padgett's Creek Baptist Church History, was also a surveyor, also a cousin from Major Duke, had platted the Mark Murphy Cemetery land".

Note:
There is a plan to restore and cleaned up the Sion Murphy Cemetery, in March of 2016, by descendants.

In a recent visit by descendants; Dale, Bill Murphy & Cousin Bennett

of the Murphy Cemetery in Fayetteville Fayette Co GA. (June 25, 2012)

"My brother, a cousin & I visited the Murphy Family Cemetery

In Fayetteville, Ga. It is in disrepair. The vets are well marked.
We found about 32/33 burials (depressions) there in 5 straight rows,
many more than is on record. It will be a challenge to name them."

"We went wo Murphy Family Graveyard , Fayetteville, Georgia, On Monday June 25, 2012. Bill Murphy, Bennett Mahaffey (Our Cousin) And we cleaned and cleared the Graveyard. We straightened several markers , cleared an opening at the road and repaired 1 child's vault that had been broken. There are 5 rows of graves with 6 graves in each row. You can determine graves by marker or depression in the ground .  There are 2 depressions in a row by themselves.  Total of 32 graves.  We dug and found numerous field stone markers.  Bill found Jane Murphy's marker.  We put Jane 's marker beside her husband Joseph Harris Murphy.  Went to Corinth Baptist in Fayette City to see the other Murphy's."

Dale & Bill retrieved Jane Murphy's grave marker that was
dug up from the forest floor and placed next to her husband
Joseph H Murphy s/o Simon Peter & Rebecca Murphy.
